End-User Software Agreement

2. License Grant

Swaralaya grants the User a limited, non-exclusive, non-transferable, and revocable license to install and use the software solely for **personal, non-commercial use**, unless otherwise agreed in writing. This license is conditional upon your compliance with all terms of this Agreement and the timely payment of any applicable subscription fees.

3. Restrictions on Use

The User specifically agrees not to:

• Modify or Adapt: Modify, translate, reverse-engineer, decompile, or disassemble the software or attempt to derive the source code.
• Distribute: Sublicense, lease, rent, distribute, sell, or otherwise transfer the software to any third party.
• Circumvent: Bypass any technical protection measures within the software, including license key management or device hash restrictions.
• Unauthorized Reproduction: Copy or use the karaoke audio files, source code, or content beyond what is necessary for personal, intended use within the Swaralaya application.

4. Ownership and Intellectual Property

All intellectual property rights, titles, and interests in and to the Swaralaya software (including the karaoke tracks, code, design, and documentation) are and shall remain the **exclusive property of Swaralaya Studios**. This Agreement does not grant the User any ownership rights, only a limited right of use under these terms.

5. Data Collection and Privacy

By using Swaralaya, you consent to our collection and use of technical and personal data (such as device hash and phone number) for license management, security, and service improvement. These practices are fully detailed in our Privacy Policy, which is incorporated by reference into this Agreement.

6. Warranty Disclaimer

SWARALAYA IS PROVIDED **"AS IS"** AND **"AS AVAILABLE"** WITHOUT ANY WARRANTY WHATSOEVER. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the software will meet your requirements or operate without interruption or error.

7. Limitation of Liability

In no event shall Swaralaya Studios or its suppliers be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of data, profits, or business interruption) however caused and on any theory of liability, arising out of this Agreement or the use of the software.

8. Termination

This Agreement is effective until terminated. Your rights under this Agreement will **automatically terminate** if you fail to comply with any of its terms. Swaralaya reserves the right to terminate access to the software at any time, with or without cause, upon notification to the User. Upon termination, you must cease all use of the software and destroy all copies.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the **laws of the Government of India**, without regard to its conflict of law principles.
